Legal Question in Family Law in Arizona

my wife wants a divorce and has moved out. I have two boys that live with me. what are my rights? she has taken all most everything out of the house. we dont want this to get ugly. I have a new truck that both are names are on title, afraid she will take that. and our house is in my name, but may loose it if i dont det a loan mod. it,s not worth the note on it. I need some answers pleeeez

First of all, you need to make sure you get educated on all of the issues that will need to be resolved including division of assets and debts, custody, parenting time, child support and others. I suggest you spend the time talking with an attorney to make sure you understand all of the issues. Second, as for the truck if you bought it during the marriage, the law presumes it belongs to both of you as the "community." That does not mean she can take it permanently. It may mean that if it has any value, it may be subject to an equalization or payment to her for 1/2 of the value. Same goes for the house.
