Legal Question in Family Law in Arizona
My wife is having another mans child do i have to sign th birth certificate or pay child support
1 Answer from Attorneys
You are not required to sign the birth certificate. Arizona law states that any child born during the marriage is presumed to be a child of that marriage. BUT, the presumption is rebuttable. IF YOU STAY MARRIED, and the natural Father is never pursued for paternity, and later on you get divorced, THERE CAN BE AN ARGUMENTS for your child support. I would expect you could prevent that possibility now either by initiating divorce proceedings, and alleging the no-common child, or at a minimum by seeking some written present confirmation fro your Wife that this child is not common.
We can certainly help you consider and then pursue your options.
