Legal Question in Family Law in Arizona
My wife and I were married in California about three years ago.We have a son together. We decided to get a divorce a year and a half ago and filed separation papers. She now refuses to communicate on the matter. What happens if I file for divorce papers and she refuses to sign or does not respond?

She is not required to sign anything but you do have to file and serve her. If she fails to respond you can ask the court to default her.
You can obtain a dissolution in Arizona even without her participation. Does she live in Arizona? Does the child? You may have jurisdictional issues.
We can certainly help you consider and then pursue your options for divorce. This is obviously a very important matter, and you should not go in alone.
One of our attorneys can explain the issues and procedures better in person. As you can imagine, there is too much to cover via email. We offer free 1/2 hour consultations, in which we can discuss your matter in detail.
Please call us directly to discuss the specifics of your matter, or contact my assistant Gina or my paralegal Jennifer to schedule your free 1/2 hour consultation.
