Legal Question in Family Law in Arizona

My wife have been married for 15 years and have two daughters together 5 and 6. Can we get a divorce or separation where we can decide what I pay in child support and I keep my retirement? Or are we stuck with the court decisions which are too much? Both my wife and I are in agreement.

Generally speaking, the court will only make the decisions when the spouses cannot reach an agreement between themselves. If you can reach an agreement regarding the division of your property, the court will generally accept that. If you reach an agreement for child support that is different than what the "guidelines" provide, then the court can accept that agreement, but only if certain requirements are met.

Yes, we absolutly can submit documents wherein the two of you agree to a certain amount. If it is a substantial deviation form the guidelines, we may need to draft a separate "agreement to deviate" which explains the basis for the deviation. It is very simple.

We can certainly help you consider and then pursue your options. We offer a flat fee of $1200 plus costs for uncontested matters.

One of our attorneys can explain the issues and procedures better in person. As you can imagine, there is too much to cover via email. We offer free 1/2 hour consultations, in which we can discuss your matter in detail.
