Although the law presumes that a child born during a marriage is the legal child of the husband, if someone else is the biological father, that person can file a paternity action to assert visitation rights to the child, and that person may also be responsible for paying child support. Another option might be for the biological father to consent to you adopting the child so he no longer has any legal ties to her and she would be considered "yours" as though you were her biological parent.
