Legal Question in Family Law in Arizona
My x-wife takes me to court at least 3 times a year. She has filed false sheriff reports and even an order of protection on me, which was dismissed. Is there a law against her harassing me in this manner? She said she'll do it until my child is 18. I pay my child support (garnished) and follow all court orders as in the divorce papers. I've been divorced over 3 years and have re-married over a year and this all started when I got married.
1 Answer from Attorneys
Do you have her on tape admitting that she will continue doing so?
I would have requested some sort of sanctions the last time she took you to Court unsuccessfully. OR, do so the next time.
Typically, you will not be able to prospectively limit someone's ability to file a lawsuit. Hopefully, if she gets sanctioned once or twice, she would think about it before going forward with another.
We can certainly help you consider and then pursue your options.
One of our attorneys can explain the issues and procedures better in person. As you can imagine, there is too much to cover via email. We offer free 1/2 hour consultations, in which we can discuss your matter in detail.
Please call us directly to discuss the specifics of your matter, or contact my assistant Gina or my paralegal Jennifer to schedule your free 1/2 hour consultation.
