Legal Question in Medical Leave in Arizona
FMLA vs. worker's compensation
I have a condition which is being investigated as to whether it is a workmen's compensation claim. My employer says even if it is foudn to be workmen's comp, I still have to use FMLA time. I thought FMLA was for personal injury/illness, not job-related.

Re: FMLA vs. worker's compensation
Unless there is some state law to the contrary, FMLA time is for anything that qualifies for a 'serious health condition.' For more information about what is a serious health condition, you can visit my website, www.memphisemploymentlawyer.net. You can also visit the DOL website, www.dol.gov.
You also may be protected by state laws. In order to determine what rights you may have under state law, you would not to consult with an attorney in your state.
