Legal Question in Medical Leave in Arizona
Risking job by applying for family medical leave?
My employer allows 3 sick days a year. Then they begin the "concurrent reports" which lead into the disciplinary system. The form states failure to comply will result in further disciplinary action, up to and including possible termination. I have just learned that the Fam. Leave Act can be applied for to cover days lost from work due to a chronic illness. I have Chronic Fatigue and Immune Dysfunction Syndrome. I am concerned that applying for Fam. Leave Act to cover days lost due to this illness will open a door for my employer to find a way to fire me. Stranger things have happened. I wish to continue to work for as long as I can keep my health to a level where I can work. Rumors fly about nurses losing their jobs simply because a dr. did not like them, that other reasons are then developed for the firing, such as "reorganization" (which seems to be THE legal loophole these days.). I do not want to lose my job, and feel that the Fam. Leave Act could be protection for me, but do not want to take any chances.
