what's correct legal term for malicious harassment?

is 'dismiss with prejudice' the same as 'summary judgement'?

Be really cautious about representing yourselves in these kinds of actions....I am particularly concerned over suits regarding people's homes and the potential for liens to be placed on homes. TO answer your question, a motion to dismiss is different than summary judgment. Motions to dismiss can be made for many different reasons. Motions for SJ are only appropriate when there are "no genuine issues of material facts." In other words, if all major facts are agreed on by the parties, and in that case, there is no legal calim against you in your position, a Motion for SJ is appropriate.
