Legal Question in Civil Litigation in Arizona

If my husband "borrowed" money from a joint account with his mother, with the understanding (verbal only) that he would begin repaying her in 2011, can his sister sue him for the money now? His sister is not his mother's legal guardian, and she was not part of the verbal agreement- she found out about it a year after it took place.

It sounds like there may be some issues about your mother-in-law's capacity. If so, and your sister-in-law, pursues guardianship/conservatorship, she may bring an action on this debt. However, if all is fine, the sister does not have standing to bring suit. I would urge you to consult with an attorney to go over what has transpired.
