Legal Question in Civil Litigation in Arizona
My husband was served with a civil summon and clearly he does not associated himself with the
plaintiff - We had faxed over my husband the SS card with the last number, along with the Passport
that information blackout - Now, they came back and said they can't see the picture because it was dark via the fax.
My attorney obviously doesn't have any knowledgement of the Asian culture, where the Middle name of the person is actually the birth name from the parents , and the first name is just the name that people called themself for easy pronounciation
We felt like they are harrassed us and we have to approve that we are not the one that they are looking for.
Is there a way that we can protect ourselves?
Oh the plaintiff told that they think we are the person that they are looking for, because I claimed to say that my husband name is the middle name and clearly it shows differrent .
for Example
The plaintiff Tony Hong Diem HU
and my spouse name is Tony Tien Huu Hu
So they claimed that Tony Hu it is and they got who they want to sue.
It must be something that we as the citizen can be protect by these harrasement lawyers, and I am seeking for your help on how to approach it .

The plaintiff has to prove their claim against your husband. I would advise you to have an attorney review the lawsuit and respond to the plaintiff as soon as possible. Typically, you have 20 days to file an Answer from the date you were served, unless you reside outside of Arizona, then it's 30 days. You may contact my office to discuss this further.
