Interferance with contracts by ex employee
A recently fired employee of my small business is interfering with contracts between me and several of my customers. He has caused roughly $3,000 worth of damages by canceled contracts and who knows how much in future business. The agreement he signed upon hiring stated that if he chose to leave our business, he would encourage his direct customers to finish out their contracts. He did not choose to leave, he was released because of several breaches of conduct laid out in our employee handbook. Is that ex employee still held by his agreement, and if so, is he responsible for damages?

Unwarranted interference with contracts between a business and its customers is an actionable tort whether or not one has signed an agreement not to do so. If such interference is proven, damages may be awarded against the tort feasor to compensate for the demonstrated economic loss to the business.
