Legal Question in Civil Litigation in Arizona
I have received a copy of a MOTION FOR ALTERNATIVE SERVICE from a lawyer. I'm not sure exactly why I am being sued so I would actually like to see the complaint. However, the process server's affidavit attached to the copy of the motion states that he has tried to serve the papers three times unsuccessfully and twice states that I am avoiding service. Nothing could be further from the truth. Other information in his remarks confirms that he is lying about his attempts to serve. I am somewhat irked that he is lying to the court but I am mostly angry that he is portraying me as avoiding service, which in my mind would imply some kind of guilt. Is there something I can do or should I just "get over it"? (Note: This is not a criminal matter. Since the Plaintiff is Chase Bank, I assume it has to do with a foreclosure I suffered over a year ago.)
