Dear Inquirer:

If you entered the US without a visa, you will not be eligible to get a green card in the US, unless there was a petition filed on your behalf for permanent resident status on or before April 30, 2001. If you marry and your spouse is a US Citizen, we could make a decision whether you could file in the US or seek a visa from outside the US for the green card. There is a bar to readmission for ten years for people who have been unlawfully present in the US for more than one year, so we would have to be very cautious and consult with an immigration attorney regarding the waiver (perdon) provision for this ground of inadmissibility, before you decided to depart the US.

I recommend that you email [email protected] or visit www.hanlonlawgroup.com if you would like to schedule an appointment for a confidential consultation to discuss this matter further.
