Legal Question in Immigration Law in Arizona
Affidavit of support
My employer filed first-employment based immigration foe me. My wife and me are going to file I-485 with the notice of action for my I-140 petition. Does my wife need to file Affidavit of Support? If so, which form shall I use, form I-864 OR form 143? I am not a permenant resident, can I use this form?
Thanks in advance!

Re: Affidavit of support
The affidavit of support (i-864) is generally not required in employment-based petitions, unless you own at minimum a 5% interest in the petitioning employer's business or your are related to the employer. In some cases it helps for your spouse to file an I-134 to show that she will not become a public charge.
