Legal Question in Immigration Law in Arizona

I'm a US citizen and I meet my boyfriend a year ago and we are planning on getting married in 2 months. He has been living in california for 3 years and has been attending school and working with a fake social security number. He has been using a fake social security number but has been using his real name and age. He bought a car and got insurance in his name and has only been stop by the cops once for speeding. The problem is that he came to the US without inspection. My question is, what would be the best and easiest way to help him get a green card? What would I have to do?

You would need to file a petition for him as an immediate relative. However, you should consult with an immigration attorney as your boyfriend entered without inspection and has used a fraudulent social security number. For assistance, please contact my office at 1-800-408-5818.

Did your boyfriend enter the country with a valid visa. Was he inspected? If so, you can file an immediate relative petition and adjust status in the U.S. If you need further help, I can be reached at [email protected]

Once you marry your boyfriend, he will be eligible to obtain a green card as a spouse of a U.S. Citizen.

Since your boyfriend entered without inspection, it will be a bit tougher for him to get his green card. If there was an immigrant visa petition filed on his behalf before April 30, 2001, he may be 245i eligible. If he is 245i eligible, he can adjust his status while staying in the U.S and will not have to leave.

If he is not 245i eligible, he will have to obtain his green card through a U.S. consulate abroad with a waiver for his unlawful presence. The waiver will have to demonstrate that his U.S. Citizen/Legal Permanent Resident spouse or parent will suffer extreme hardship if he is not allowed to return to the country.
