Legal Question in Immigration Law in Arizona
deportation due to arrest
We are in the process of getting my husband's citizenship and he was recently arrested. There is an immigration hold on him and what we're trying to figure out is if this is going to result in an automatic deportation because he doesn't have his citizenship or if there is anything we can do to prevent him from being deported.

Re: deportation due to arrest
It depends on what he was arrested for and what he ultimately pleads guilty to. There are certain criminal convictions that make someone deportable. However, your husband may be eligible for relief. Depending on whether he is placed into removal proceedings or not, he may be required to appear before an Immigration Judge and seek relief from deportation. From the information you have provided, most likely, he may be eligible for pursue his citizenship application by asking for termination of removal proceedings for naturalization. In the event this happens, his removal case would be terminated pending a decision from the U.S. Citizenship and Immigration Services on his application for citizenship.
Of this, you should consult an immigration attorney for a more detailed assessment of the situation, as each case is dependent upon numerous facts and circumstances.
