Legal Question in Immigration Law in Arizona

illegal immigration

someone went to jail and is an illegal here theyve been here since 1993 (4y.o. They have an immigration hold whats the likely hood of them being realeased since they were here since childhood. is there such a thing that since this is the life they know they have more of a likely hood of staying? i believe there may have been an undercover but bail was set and pretty much they just have an immigration hold.

The alien's remaining here in the U.S. depends on several points. What they were jailed for, whether there is a conviction for the charge, if they have lawful permanent residence, if they have family here and can prove extreme hardship if they are deported, if he was assisting law enforcement and convictions of others resulted, many, many questions need to be asked and answered before any counsel can tell you what the likelihood is of "staying" in the U.S. As to the immigration hold, that is called a "detainer" and is notice to immigration authorities to come pick up the person within 42 hours. If they do not, technically, the jail should release the person. Hard to do. Get this person a good lawyer. good luck.
