Legal Question in Immigration Law in Arizona
marrying a mexican national in the US
I am military and my fiancee is from mexico and currently lives there. She has the appropriate passport and tourist visa that would make it possible to marry in the US, but we wish to marry in the US then do a church wedding in Mexico in her home town. do we need to take any steps to do this? I have heard rumor that she could be trapped in mexico if she crosses to do the wedding there. Right after the legal wedding in the states, do her passport and visa become useless? or can we still cross the border and do her change of status later? How do name changes and stuff affect her ability to travel for the wedding? seems like people would marry in the states for the ease of it, but i haven't seen much light on this subject. I'm deployed to korea at right now and that pushed off our wedding for an additional year. Its disheartening to have so much law and misfortune interfere with our plans. ANY help would be great. also, any attourney with experience on the subject could email me with any additional information

You should get married here first and apply for her. Then go back to mexico with travel permit and have the ceremony.
Re: marrying a mexican national in the US
If she's overstayed her authorized stay in the U.S. by over 6 months, then she'll want to marry in the U.S. and remain in the U.S. until she receives her green card.
Only after she receives her lawful permanent residence (Green Card) will any unlawful presence bars she may be subject to be lifted.
