question on applying for h1b extension
hi
my 3rd yr h1b expires in feb 2010...what is the earliest i could apply for my h1b extension..
also, how do we know,which service center my application goes to? my employer is based in California...does that mean it goes to california service center.

An extension may be filed no more than 180 days prior to the current expiration date of your authorized H-1B status. The petition should be filed with the California Service Center.

An employer may file an I-129H Petition up to 180 days prior to the employment commencement date. The location of the place of employment controls the filing location, which may not necessarily be the employer's headquarters location.

I believe the earliest is 90 days prior to expiration. As for the service center where the renewal application should be sent, the instructions on the forms should indicate which one, but in your case it's most likely the California service center.
