Legal Question in Immigration Law in Arizona

US woman married to incarcerated Mexican National

Recently I was asked by a detective if I was receiving any benefits for my husband, which I'm not. I am curious now, as with my husband, as to if I am entitled to benefits for him. He is not legal and is currently on death row in AZ. I am a legal US citizen.

Re: US woman married to incarcerated Mexican National

There is no uniform set of rules for benefits, as they may be administered by a patchwork of state and federal agencies but a general observation can be made: they tend to exclude persons who are not already US citizens or permanent residents and/or are persons convicted of crimes and incarcerated.

It is possible that the detective was trying to find out whether you had attempted to get benefits for your husband to which he was not legally entitled; and if having put the idea into your mind, whether you will attempt to obtain them for him whether legally entitled to do so or not.

This is not legal advice and there is no attorney-client relationship created but I would be very cautious about going down this road.

Good luck.
