Legal Question in Insurance Law in Arizona

Act of God in a Auto Accident

I'm a resident of Arizona. On Thanksgiving day my parents and niece were involved in a head-on collision. Both of my parents passed away that day, and my niece spent a few weeks in critical condition at a regional hospital. The other driver was a 74 year old woman who served into my parents lane on a two lane mountain highway. The autopsy shows that the woman had suffered a pulmonary embolism and possibly was dead before impact. The woman's insurance company is trying to claim that it was an ''act of god''. My sister does have a lawyer, what I want to know is can a medical event such as this be legally considered an ''act of god'', and what might qualify it as such?

Re: Act of God in a Auto Accident

I am truly sorry for your loss.

More facts need to be known in this case. I have had many cases as an attorney where the insurance has claimed "act of God," and I have never lost one of those cases. I have seen defendants who claimed they blacked out, had a heart attack, sneezed, fainted, etc. just before the accident.

You should call so that more information can be gathered. The call is free, of course. 480.835.1500.

Thanks,

James D. Jenkins
