Legal Question in Insurance Law in Arizona

My daughter recently purchased auto insurance thru a carrier, for which I filled out the on line application.

In filling out the application, I accidentally put in my own date of birth....

We realized the mistake and contacted the agent with the proper information.

He acknowledged having received the information, via e-mail and insisted that her quote was going to stay the same.....He further ran her motor vehicle record - which was the correct record. (as such, it should have also included her proper birthdate thru the DMV)

After having received the policy - I found that he has placed my birthdate on it instead of my daughters.

Now - he is claiming that the auto insurance rates will triple and that we gave him "false information" which is insurance fraud!

He will not even acknowledge the fact that he WAS given the proper information and I have proof indicating same!

Obviously, he will not step up to the plate and take care of the situation.

Do I have any legal recourse?

Yes. See if you can file a complaint with his supervisor or someone at corporate headquarters. He is failing to rectify a mistake that was a complete accident. Inform them that if it is not rectified in a timely manner you will file a lawsuit.
