Legal Question in Insurance Law in Arizona

Medical bill

The employer I worked for has filed Chapter 7 Feb 4, 2008.

The Group insurance was cancelled.

The Group Insurance sent me a certificate of coverage valid thru January 31, 08.

The Group Insurance will not pay a claim from a procedure I had done January 15, 2008.

When I called the Group Insurance, they said the ''fund'' my employer paid in did not have ''funds'' left, so they could not make payment.

The procedure was pre-authorized AND I was still covered by insurance at that time (certificate states that).

The hospital has now billed me (almost $18,000.00).

What do I do? I know the hopital always was paid less than full amount by the insurance before - yet they billed me the full expense.

I am unemployed now - no funds to pay.

But mostly - I had a pre-authorized procedure done with insurance that was in effect so I don't think I should have to pay at all.

Shouldn't the Group Insurance company be responsible to pay the hospital and then they go after my employer thru the Chapter 7 process?

My employer was based out of Las Vegas, NV and I worked in a location in Arizona.

I do not know if this is an Insurance Law question or Bankruptcy question.

i suggest you contact Wayne Arnett in Tempe, Arizona who handles "bad faith" insurance cases, where insurance companies fail to pay a claim they are obligated to pay. Bankruptcy is a last resort if your claim fails; see Mark Atchley in Mesa, Arizona for that.
