Legal Question in Insurance Law in Arizona

Can you sign for your spouse in arizona?

In Arizona, is it legal and acceptable for a spouse to sign a health insurance application if one is not available to sign? I have heard that this is legal...but can not find any documentation. Thanks for any help you can provide.

Re: Can you sign for your spouse in arizona?

I am not sure of all the facts. Why is your spouse not available to sign? Since insurance applications generally have representations as to health history, etc. I would believe that both spouses should sign personally. It is not legal to "forge" a signature, but between spouses there may be an implied license. If you ask the insurance company they would probably state that the spouse needs to sign. Rather than risk a denial of benefits later, why not have the spouse sign? And do you not have a proper power of attorney in your estate plan that permits you to act on the spouse's behalf? You may want to get one. For more information we offer a free audio CD explaining the components of a well-ordered estate plan.
