Legal Question in Intellectual Property in Arizona

Trademark Search for Setting Up A Non-Profit

I'm trying to do a trademark search for a name I'd love to have as a non-profit organization and I'm a little confused at the results. There are several already-existing entries in the trademark database marked as live. If there are already a few with the same name, what are the limitations for me as a non-profit to also use the same name?

Re: Trademark Search for Setting Up A Non-Profit

Trademarks are registered for specific goods and services, such as Delta(R) faucets and Delta(R) airlines. If there is no likelihood of confusion with the existing mark including its natural areas of expansion, the same mark can register for different classes of goods and services. Note, however, that if a mark has become "famous", it can preclude a competing use that dilutes or tarnishes that mark.
