Legal Question in Employment Law in Arizona
I have a case with my local EEOC. It is an Harassment case with my employer. I know the investigation was over in may 09. What and when will I recieve information on the next step. Since it has been a few months does that mean they will take the case? Would my employer find out something before me?

Thank you for the inquiry. It is always difficult to say when the EEOC will formally conclude an investigation. If they determine there is "cause" to believe there might have been a violation of the applicable law(s), the will try to help the parties settle. If that does not produce a settlement, they will issue a notice of right to sue. You then have 90 days from the date they mailed the notice of right to sue within which to file a court action.
The delay probably does not mean it is any more likely the EEOC is going to bring suit on your behalf. They do this in only rare occasions. Finally, you and your employer should receive word on the results of the investigation at the same time.
