Legal Question in Employment Law in Arizona
Consultant to Permanet at a competitor
I have been working as a consultant for the past 6 months and the contract is about to expire. I have been offered a permanet position with a direct competitor. I was not asked to sign a NDA but the consulting company that I work for may have. I do have knowledge of how the company works and some of their challenges but nothing about trade secrets nor propritary information. What are my options?

Re: Consultant to Permanent at a competitor
We would be interested in seeing the contract that is about to expire to determine if there is any reference to a contract between the company and the consulting company you work for. Obviously, any contract that exists is important and advice can only go so far in the absence of knowing what that contract says. We can certainly advise you as to what Arizona law says about competition, disclosure and proprietary information and how it affects you personally.

Your rights will depend on the terms of any agreement you signed. If you did not sign any sort of non-compete agreement or agree in your contract to be bound by another document that might contain a non-compete clause, you will be free to go to work for a competitor.
