If I take a day of sick leave, can my Employer take overtime away as pay for time off?

Thank you for the inquiry. Under the FLSA, an employee is entitled to overtime hours for only hours the employee actually worked. If you worked ten hours a day on Monday, Tuesday, Wednesday, and Thursday of a workweek but then used sick time for Friday, you would not be entitled to any overtime pay for the sick time you use.
