Legal Question in Employment Law in Arizona
Can an employer disciple a employee for missing work for health related issues if there is medical documentation from a doctor supporting the time off?
1 Answer from Attorneys
An employer, in this economy seems to hold all the cards. If you have a policy which allows 4 absences from work for illness... and you take 10 absences, the employer can fire you if it wants. Unless you have been placed on disability, maternity leave or have some other issue that qualifies under the Family Medical Leave Act, an employer can discipline you for excessive absentee issues. Employers have a right to expect that you will come to work and that you will not take excessive time off the job. That is why they have policies that give you so many sick days with pay... and they don't pay you for anything beyond that... in fact... they just might fire you. If your employer is violating maternity leave or family medical leave laws, then you have a case... otherwise, if you think the employer's policy is too tough, you should find other work.
