Legal Question in Employment Law in Arizona
My employer filed for Chapter 11 and has not paid me...
I was recently laid-off by a company I was working for as a contract employee--no explanation given at the time. My supervisor told me that they would be mailing my last paycheck to my residence.
A few days later, it was all over the news that the company has filed for Chapter 11. Weeks have passed since I was told I would recieve my paycheck. I wonder how likely it is that I will ever see the money I earned? I have tried calling the company but the phone is not answered.
I found information online that there has been an '' Order Granting Application for Authority to Pay Pre-Petition Wages and Benefits (Related Doc # 8). Signed on 11/20/2008''. and ''Telephonic Notice of Hearing regarding Debtor's Emergency Application for Authority to Pay Pre-Petition Wages'' on Nov. 21, 2008. I have no idea what this means, if anything.
*Does filing Chapter 11 erase the liability of a company to pay their employees?
*What are my options at this point?
*As a contract worker I was told by the company that I would not be eligible for unemployment compensation. Is this true?
The company is headquartered in Florida and I worked for the Arizona offices.

You should send a letter or e-mail to the bankruptcy attorney in charge of the case asking when you will be paid to make sure they have notice of your claim.
