Legal Question in Employment Law in Arizona
Not hired after 90 days?
The company that I am employed with at this time hired me over the phone with an agreement that I work 90 days so that they may evaluate me before hiring me on full time. Now that i have quit my job, moved 2,000 miles, disrupted my family, who still live 2,000 miles away, this company says they have a hiring freeze and cannot put me on perminent. 90 days have past, they have told me that they are pleased with my work and don't want to lose me but I cannot be with out health coverage for my family. My question is can I sue for breech of contract even though I have nothing in writing? (This is a very large aluminum company) Any guidance will be appreciated Thank you

Re: Not hired after 90 days?
Cannot tell you based on the limited info. First, what were you promised? If they promised you more than ninety days then you may have a claim. It sounds as thought you took the risk, since it was made clear that you might be terminated after ninety days. On the other hand, if they knew you were quitting, knew that you contemplated a regular position, and at the time they knew or should have known there would be a freeze, then there might be claim, lack of good faith and fair dealing (if this is recognized in AZ. I am not an AZ attorney. OVerall sounds like you took a risk and it did not work out. If there are more facts, than the conclusion may change. The bottom line is that unless you can tell the exact terms of the "agreemetn" for employment, theres no definite contract, and no claim.
