Legal Question in Employment Law in Arizona
My husband was accommodated to work at home for his epilepsy . He has worked from home for the past 2 years. He uses his intermentent FLMA to protect him for when he needs days off during a flair up. Recently they had a newer boss 3 levels up get hired on about a year ago. This boss said that since my husbands performance is not in the top 25% off the company they are taking his accommodation away and having him come into work. Is it right for him to compare performance to other employees that don't have a disability. Is it in our best interest to consult a local employee attorney?
