can a potential employer ask about gender or ethnicity during interview process?

There is nothing that would make such questions per se illegal. Doing so, however, is bad policy, as it subjects the employer to potential liability under Title VII. Such questions could be evidence of illegal discrimination if the employer asked about national origin, learned your national origin, and then hired someone outside of that group.
