Obtaining copies of past annual reviews

My job was eliminated recently at a software company located in Arizona. I was a virtual employee who lives in Florida.

I requested copies of all of my past annual reviews from the last 5 years because I do not have a complete set of these files. The Director of Human Resources replied that the company does not give out copies of past reviews and would only do so if shown that they were under legal obligation to do so. I worked for the company for 5 years and 4 months.

Do I have a right to obtain these copies? Do I have a right to obtain a copy of my entire employment file with that company?

I am sorry that happened to you. I am always surprised when companies do something like that. They fire you then insult you like you do not have obligation.

Legally I cannot think of a requirement in Florida, but if you employ a lawyer to write a letter, I am sure they would comply.

Unfortunately you do not have any legal right to view or obtain a copy of your personnel file because this information is considered property of your employer. Accordingly, the only way you can compel production of your file is in the course of a lawsuit where that information would relevant to some claim.
