Legal Question in Landlord & Tenant Law in Arizona
I think my landlord is charging unfair late fees. Do you?
In June I made an accounting error and didn't leave enough money in my checking account to cover my rent check. To rectify the situation I paid my rent plus a $50.00 returned check fee with a cashiers check. For the next three months I paid my rent by check, which has been accepted each time. This month my check was returned to me stating they would not be able to accept the check per the lease agreement section about returned checks. Haven't they set a precedent that they will accept my checks by accepting the last three? I don't mind getting them a cashiers check if that is what I have to do, but I don't want to pay late fees when I paid on time and in the same manner that I have been paying. Please help!

Need to see the lease, since it controls.
