my landlord quit paying their mortgage on this house 6 months ago and it is going up for auction oct 8. i have been out of work for about 3 months and have not been able to pay rent. they are threatening me with a forceable entry and detainer. where do i stand?

If you owe back rent, there is very little you can do the avoid being evicted. If the property is sold, the new owner will probably be bound by any previous lease or rental agreement...so if you have not paid rent, they will be able to file an eviction action in court. It may be time to find a new place to live.

The fact that you have been unable to pay rent due to economic circumstances will not be a defense in an eviction/forcible entry & detainer.
