I practice in Southeastern Arizona, primarily in Cochise County. You might want to contact an attorney to help you with this case. It was not clear if you where renting the home or buying it. If you are renting, I suggest you contact the landlord IN WRITING about the circumstances and that you are no longer living there and can no longer pay the rent�

If you are buying, not renting, then it is important to look at the documents FIRST-deed, whose names are listed on the title as owners and SECOND-who is listed on the Mortgage as being responsible for making the monthly payments. If you bought the house after you were married, then you should file for divorce as soon as possible and get the court to determine ownership.

If you bought the house before the marriage and your name is the only one on the deed, you should still file for divorce asap, and ask the court to award the house to you as separate property. GOOD LUCK,
