Legal Question in Landlord & Tenant Law in Arizona
We leased a commercial space advertised as a fully built out restaurant. After we signed the lease we went to the city to get permits for some minor construction on the inside, that is when we were told the space was always retail, it was never permitted as a restaurant, so, we had to have the occupany changed from retail to restaurant which cost us over $5,000 for an architect to do plans and drawings. If we knew this in advance we would not have signed the lease. Who is responsible for the cost of this occupancy change? We feel the space was a material misrepresentation.
