Legal Question in Landlord & Tenant Law in Arizona
I want to get out of a rental lease because the apartment management refuses to move or evict my neighbor who is quity of breaking the noise ordinance laws of tempe. I have looked at the lease and have tried to present arguments to get out of the lease and not pay fees. Can you help?

You have to prove that the landlord has failed to provide you with the "quiet enjoyment" of the apartment. If you can document and prove to the satisfaction of the court that the noise prevents you from sleeping or living happily in the premises, then the court should terminate the lease and you may be able to collect damages as well. You have to take action, go to the nearest Justice Court to get the forms and see a copy of the AZ Landlord Tenant Act.
