Legal Question in Legal Ethics in Arizona
I was in a car accident. It was the other driver's fault and his insurance company is paying for the damages. I am using a lawyer who is a friend of the family. He is trying to convince me to let him give my mother the check. I have told him that I want it given to me, but he says he would rather give it to her, something about squandering and bar complaints. I am over 21 and live on my own. Is there any way he can give her my money against my will? Should he even be talking to her about my case without my permission? I don't want to hurt my relationship with him or my mother, but I don't want my mother to have control of my money either. What can I do?

When you are represented by counsel it is inappropriate for other lawyers to communicate with you regarding the subject matter of the litigation. If you have not received specific advice it is because lawyers do not want to interfere with your relationship with your existing lawyer. We suggest that you communicate with your existing lawyer regarding this issue and advise him regarding how you want your settlement proceeds disbursed.
