Legal Question in Legal Ethics in Arizona

He was fired and I agreed to pay back any monies that might have been given to me that I should not have gotten. The company said that I had been over paid by 20,000 for the 5 years that I worked there. I paid them the money. They then came back to be and said I owed almost another 3000.00 because my ex-husband borrowed from my 401k. I did not have the money and said no, so they went and tried to press charges against me. I worked with the Scottsdale, AZ police for 1.5 years to get all the information that they needed. My ex-husband was charged and found guilty he also agreed to pay back all the monies he took. The Scottsdale police never charged me and said there was nothing there to prove I knew or helped my ex-husband.

Now in 2012 I contacted my 401k company to get the freeze off of my account since I was not charged, they told me my old company the one that the monies was taken from would have to approval the release of the funds. I contact my old boss and was told that I would have to pay them a little over 6000.00 for them to release my 401k since they say was repaid back to my 401k with stolen monies.

My questions is since my ex-husband was found guilty not I and he has already been ordered to repay all the monies he took, can my old company ask me to repay the loan on the 401k back to them? Also when my ex-husband took out the loans on my 401k I never agreed to it nor did I ever sign anything stating that I allowed the monies to come out of my 401k.

What should I do?
