Legal Question in Military Law in Arizona

Absent Without Leave: Consequences

What are the consequences of going absent without leave within the first 180 days of enlistment service? Does not having completed basic training due to medical problems have any bearing on the situation?

Re: Absent Without Leave: Consequences

The consequences are the same as any other time

on military active duty. You could get non judicial punishment under Art. 15, UCMJ, if you agree; or you could be court-martialled, and if you were away for more than thirty days you are probably declared a deserter and dropped from the rolls of your military unit.

If you have legitimate reasons for not serving, return to military control and assert them through the proper channels. And be aware that if

you lied about a medical condition when you came in to the service, and did not get the medical problems alluded to in this post while on active duty, but in fact had them upon entry, you have more problems.

Military service is different from a civilian job. You cannot just walk away from it.
