Legal Question in Military Law in Arizona
dispute over debt need help
I am in the army and am trying to recover some money I lent to another soldier. No one will help me. I tried JAG and they said to file with the courts. The courts said I couldn't because of the soldiers and sailors act. Then JAG told me to fill out an article 139. Which I did and found out I couldn't go through with it because it is not a criminal act. JAG won't help me and neither will the Court system; where do I to recieve help and/or information. Need help ASAP. Please.

Fortunately or unfortunately the Soldiers and Sailors Civil Relief Act prevents a successful lawsuit against this person, at least presently. But here is what I would do. I would send the guy a letter and tell him that he had 10 days to pay me. I would send it certified, return receipt. I would then take my documentation to his first sergeant and explain the situation and ask the first shirt if he could speak to him informally about the matter. Sometimes an NCO can get a lot more done indirectly than by going through channels.
I don't think there's much of a legal solution to your problem.
