Legal Question in Military Law in Arizona

Suspension of Secuitry Clearance for Personal Misconduct

Hello-

My partner was recently terminated from his job of 2 years because his security clearance was suspended. This was a huge surprise to us. Apparently, his clearence was suspended on Dec 29, 2003. He was discharged from the Military in Oct 2003. He was discharged for being gay. The reason the clearance was suspended was listed as ''personal misconduct''. We can only assume that something was filed as a result of him being gay. To top things off, we didn't find out about his 'suspended clearance' until 3 months ago. He had been working in a job through a civilan company which required a clearance. We are uncertain as to what to do or who we can contact. My partner would like to get his clearence re-instated in a timely fashion. We feel this is discrimination and highly upfair. Any help you can give us would be greatly appreciated.

Thank you for taking the time to read this.

Re: Suspension of Secuitry Clearance for Personal Misconduct

Yes, there should have been a Statement of Reasons why there was a termination. Also, there are appeal rights.

We do many security clearance cases and litigation.
