city negligence in sign posting serious injury accident atty question

I was recommened to an atty for an accident my husband had where inadequate signs were posted. He was very seriously injured, is still hospitalized 3 weeks since. A whole new set of signs in addition to the original sign have not been added to the construction zone. My question is that the contract from the atty requires a 40% fee on contingency, but we would also have to pay all ''costs'' incurred including first class air fare for expert witnesses, computer research, investigations etc. It would also come out of any settlement but seems excessive in its scope. Is there any negotiating to be done there or is that standard?
