Legal Question in Personal Injury in Arizona
compensation for pain, suffering and medical bills
I was in an accident that was not my fault and suffered whiplash that needed treatment. My physical therapy bills totaled almost $4k ($550 out of pocket), not including MRI. My doc said I will most likely have chronic pain (my neck is not the same and i still get headaches) and possibly premature arthritis. The other driver has the same insurance I do. They offered me $4k to settle. I think this is low. What is reasonable compensation for the medical bills and pain and suffering (inablility to sleep well, inability to exercise, having to make up work for going to physical therapy, etc.)?

First: You need to be the best you can be in accordance with MRI and X-ray. Do not settle quickly.
Offer is low.

You received a low offer because you had no attorney, and were percieved to be a person who would not be aggressive in pursuing your rights. You are not really able to file a suit and take them to trial on your own, so they threw you the lowball.
It is really not possible to know the value of your case without more facts, about the accident, your diagnosis, treatment, prognosis, who your doctors and medical providers were, what the exact findings of the MRI were, etc.
We offer free no-obligation consultations in accident cases. Consider speaking with an attorney. I have experience in handling a great number of these cases since 1979 in Arizona. We also have literature on how cases are valued. If you want to talk, bring all your paperwork, police report, medical bills or records you have and any letters from the insurance and you can speak to me personally. I do not have junior attorneys, and while we are selective in our cases, I act as personal attorney on all phases of the case. You can call 480.835.1500 if interested.
