Legal Question in Personal Injury in Arizona

Can I make insurance fix my car?

I have a 1991 Acura Legend LS with all the extras - gold package, cd, wheels, moonroof, power everything. It was my father's (he paid $41K for it in 1991) and I bought it from mom after he died. It has great sentimental value. I love the car and baby it big time. It has 97K miles.

I was rear ended a week and half ago by an oversize truck while stopped at a stop sign. I have significant damage and it is looking as though their insurance company may call it a total loss based upon the appraiser's opinion. My problem is that what they may pay me for it ($3K-$4500 I'm guessing) would not allow me to purchase a similar car and I can't afford any additional payments at this time. There are some of my model for sale but very few and most are in worse condition that my car prior to being hit or in a faraway state.

I truly just want my car fixed. Can I force them to fix my car? I am furious that I can lose a car I love because someone couldn't pay enough attention while driving to hit their brakes. I work from home so I'm not really losing time from work and aside from some mild soreness the first few days, I wasn't hurt.

Can you offer any suggestions as to how I should proceed?

Re: Can I make insurance fix my car?

It is possible to encourage the insurance co. to fix the vehicle and there are other ways to keep the car. My concern is for your well-being.
