Legal Question in Personal Injury in Arizona
Personal Injury Demand
I am representing myself in a claim against Farmers Ins. I was run over on my bike by a 17 year old driving an SUV. I need to know whether I can redact medical records that are irrelevant to the accident or if it will look like I'm tampering with them. I also need to know how much a huge permanent scar on my right knee is worth and how I would calculate how much to ask for in settlement when I'm still having knee pain 1.5 years after the accident.
Thank you.

Re: Personal Injury Demand
You are representing yourself, but I predict you would be better off with counsel, especially with a difficult carrier like Farmers. I have had many bicylce claims against Farmers where they did not accept responsibility for cases the court ultimately decided against them.
It would be impossible to give you an answer to your questions because you gave too little detail. I have no photo of your scar. What are your other injuries? Medical bills? Past medical conditions? Do you have prior claims or injuries? How exactly did the accident happen? Are there witnesses? Are there written statements given that are of record? Is there a police report? What reports have the doctors rendered? Has any doctor stated in reports that you have ongoing injuries from the accident?
For a fair analysis I would need to see you in person for a free consultation if you want to seek counsel. 480.835.1500.

Re: Personal Injury Demand
There should be no need to redact any of your records because the insurance company has a right to know if you were previously injured. All of the value in your case will be determined as to your pain and suffering and your current medical bills. If further surgery is necessary, the value of the claim may increase. What is the policy limits of the individual who struck you? Do you have underinsured or uninsured motorist coverage on your personal policy? These questions are all relevant to your injury.
