Legal Question in Personal Injury in Arizona

Personal injury due to faulty equipment

This is concerning an accident that happened at my work less than 10 months ago. It involves a faulty piece of equipment that has left me with a severe 10'' scar on my leg and an ongoing pain when going through normal routines. My employer covered the medical bills but due to Work Comp. laws, I was unable to recieve wages or out of pocket expenses. I am curious to know what the statute of limitations are and how to handle this, since I have recently relocated to anther state. Any help on this would be greatly appreciated.

Re: Personal injury due to faulty equipment

Workers' compensation should have paid you 2/3 of your average monthly wage (up to a maximum payment of $1600 per month) for lost wages. In addition, if your injury was caused or contributed to by the negligence of someone who is 1) not your employer, and 2) not a co-employee, you may be able to file a "third party" lawsuit and recover damages, which would include pain and suffering, and which would not be subject to the same limitations as workers' compensation benefits.

Moving from the state should not pose too much of a problem for either workers' compensation or a negligence suit. I hope this helps. You can call if you have more questions.
